Melona dessert competition official rules

1. ACCEPTANCE OF OFFICIAL RULES. By entering the Melona Dessert Competition (“Contest”), contestants accept and agree to be bound by these Official Rules. Any violation of these rules may, at the discretion of Xen Media, Inc. (“Xen Media”), result in disqualification. All decisions of the judges regarding this Contest are final and binding.

2. ELIGIBILITY. This Contest is open only to legal residents of the State of Hawaii who are 13 years of age or older as of the date of entry. Minors who are who are 13 years of age or older but under 18 years of age as of the date of entry are eligible to enter the Contest with the permission of a parent or legal guardian of the minor.

3. ENTRY PERIOD. The entry submission period for the Contest begins on October 9, 2023, at 12:00 a.m. HST and ends on November 30, 2023, at 11:59 p.m. HST (the “Entry Period”). All entries must be received by the end of the Entry Period. Entries submitted outside of the Entry Period will not be considered. The Contest will be held on December 9, 2023, from 12:00 p.m. HST to 3:00 p.m. HST (“Event Day”) at Kapiʻolani Community College (“KCC”).

4. HOW TO ENTER. Contestants may enter the Contest by submitting their entry through social media platforms, including Instagram, TikTok, and/or Facebook (collectively, the “Platforms”), using the unique hashtag identifier #AlohaMelona. All social media accounts must be made public for posting. Contestants may also submit their entry through the submission website at https://melonaicecream.com/alohamelona-how-to-apply.

5. SUBMISSION GUIDELINES. Contestants are required to create a dessert using any Melona Bar flavor (honeydew, coconut, banana, ube, mango, strawberry, and pistachio) or Chocolate Dipped Melona Bar flavor (banana or strawberry) with 10 additional supporting ingredients. Each contestant may only submit one dessert entry during the Entry Period. Contestants must include in their entry (a) a photo or video of the completed dessert and (b) a list of the additional supporting ingredients used to create the dessert (together with all text, photographs, images, and other content and materials submitted by contestants, the “Submission”).
Each contestant represents and warrants that their Submission is the original work of such contestant, it has not been copied from others, and it does not violate the rights of any other person or entity. Each contestant further represents and warrants that their Submission does not contain any defamatory, obscene or otherwise unlawful matter or contain any other inappropriate content (as determined by Xen Media).

6. JUDGING CRITERIA. There will be two rounds of judging. Xen Media will conduct a preliminary round to select three contestants as finalists from the Submissions received during the Entry Period. Xen Media will select the finalists no later than December 4th, 2023, based upon the following criteria: presentation, recipe selection, and quality. On the Event Day, a panel of judges comprised of culinary experts will conduct a second round of judging which includes finalists preparing and presenting their dishes for tasting and judging. Each of the three finalists are encouraged to prepare 100 servings of their dessert for the attending guests (Melona bars and the 10 additional ingredients as listed in the finalists’ Submissions will be provided at no cost on the Event Day). In the event that Xen Media is unable to secure any of the additional ingredients, Xen Media reserves the right to substitute a comparable ingredient upon consultation with the finalists. The panel of judges may score finalists’ submissions based on the same criteria as the preliminary round, and may also include execution, taste, and creativity. Each finalist must strictly adhere to the recipes used in their respective Submission, and refrain from using any additional ingredients not listed in their Submission – any deviation will be grounds for disqualification.

7. PRIZES. Monetary cash prizes will be awarded as follows: $10,000 for first place, $3,000 for second place, and $2,000 for third place. The winner of the popular people vote on the Event Day will receive a limited edition goodie bag of merchandise.

8. TAXES. Contestants are solely responsible for all federal, state, and local taxes and any other costs, expenses, or fees associated with prize acceptance and use not specified herein as being provided.

9. WINNER NOTIFICATION. The three finalists will be notified via social media and/or email by December 4th, 2023. The Contest winner will be announced on the Event Day and through certain social media channels, including, but not limited to, the Website, KCC’s webpage, and local media. Xen Media reserves the right to declare no winner for second and/or third place and thereby not award any prize for such placings.

10. PRIZE ACCEPTANCE. The contestants agree to accept each prize as awarded on the Event Day. In the event that a winner is unable to accept the prize as specified for any reason, Xen Media reserves the right to award such prize to an alternative winner, as determined in its sole discretion. Xen Media is not responsible for any delay or failure to receive the prize caused by events beyond its control. If a winner is a minor (under the age of 18), the prize may be awarded in the name of his/her parent or legal guardian.

11. OWNERSHIP AND LICENSE. All entry materials, videos, photographs and recipes become the property of Xen Media, BC F&B USA Corp., Binggrae Co., Ltd., and each of their parent, subsidiary, and affiliated entities (collectively, the “Authorized Entities”), and will not be acknowledged or returned to contestants. Entry into this Contest constitutes each contestant’s irrevocable and perpetual permission and consent, without further compensation, with or without attribution, to use, reproduce, print, publish, transmit, distribute, sell, perform, adapt, enhance, or display their Submission, and such contestant’s name and/or likeness, for any purpose, including but not limited to editorial, advertising, trade, commercial, and publicity purposes by the Authorized Entities and others authorized by Xen Media, in any and all media now in existence or hereinafter created, for the duration or the copyright of the Submission. The Authorized Entities and others authorized by Xen Media shall have the right to edit, adapt, and modify the Submission.

12. CONSENT AND RELEASE. By entering the Contest, each contestant, or parents or legal guardians of contestants who are under the age of 18, on their own behalf and their heirs, executors, successors, and assigns, release, discharge, and hold harmless the Authorized Entities, Platforms, and any other party associated with the development or administration of this Contest, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, licensees, insurers, agents, representatives, successors and assigns (collectively, the “Released Parties”), from any and all liability, injuries, losses, damages, claims, demands, actions, costs and expenses of any nature (including, but not limited to, personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) in connection with this Contest or acceptance and use of any prize (collectively, “Claims”). Except where prohibited: (a) entry into the Contest constitutes the consent of each contestant, or parents or legal guardians of contestants who are under the age of 18, without further compensation, to use his/her name, likeness, biographical data, contact information (taken from any source including photographs and videos taken at Contest-related events) and his/her Submission for any purpose related to the Contest, including but not limited to editorial, advertising, marketing, publicity, and administrative purposes by the Authorized Entities; and (b) acceptance of a prize constitutes a release by any winner, or parents or legal guardians of any winner who is under the age of 18, of the Released Parties of any and all Claims in connection with the administration of this Contest and the use, misuse, or possession of his/her entry or any prize.

13. DISCLAIMERS. Xen Media is not responsible for entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Xen Media’s servers or elsewhere. Xen Media, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the Platforms, or otherwise attempting to undermine the legitimate operation of the Contest. Use of automated processes to enter is prohibited and may result in disqualification at the sole discretion of Xen Media. Xen Media further reserves the right to suspend, modify, cancel, terminate, or modify the Contest for any reason whatsoever at its sole discretion and without liability. Contestants acknowledge that the Contest is in no way sponsored, endorsed, administered, or associated with the Platforms. THE AUTHORIZED ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, REGARDING THIS CONTEST. ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE THE PLATFORMS OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, XEN MEDIA RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT OF THE LAW.
